Welcome to StaySpark. These Terms of Service ("Terms") govern your use of the StaySpark platform at stayspark.io ("Platform," "Service," "we," "us," or "our"). By creating an account or using StaySpark, you agree to these Terms.

StaySpark is owned and operated by Matt Brown, based in Charlotte, North Carolina, USA.


1. What StaySpark Does

StaySpark is a software-as-a-service (SaaS) platform that helps short-term rental hosts create direct booking websites. You paste an Airbnb or VRBO listing URL, and our AI generates a custom website with a booking engine, digital guidebook, guest CRM, and guest book. We handle the technology; you manage your rental business.

2. Beta Disclaimer

StaySpark is currently in active development. Some features may be labeled as beta, experimental, or "coming soon." This means:

  • Features may change, break, or be removed without notice
  • We may reset data during major platform updates (with advance notice when possible)
  • Uptime is not guaranteed at the same level as a mature production service
  • Your feedback helps shape the product — we genuinely appreciate it

We'll do our best to communicate changes, but please don't rely on StaySpark as your sole booking channel during beta.

3. Eligibility

To use StaySpark, you must:

  • Be at least 18 years old
  • Have the legal authority to enter into these Terms
  • Have the right to list the property/properties you add to the Platform
  • Provide accurate account information

4. Your Account

You're responsible for:

  • Keeping your login credentials secure
  • All activity that occurs under your account
  • Notifying us immediately at support@stayspark.io if you suspect unauthorized access

We authenticate users via NextAuth.js and store your account data securely. See our Privacy Policy for details.

5. Subscription Plans & Billing

StaySpark offers three subscription tiers:

Current plan pricing and features are available on our Pricing page. All plans are billed monthly and renew automatically.

  • You can upgrade, downgrade, or cancel at any time from your account settings

6. Guest Booking Payments & Platform Fee

Guest payments are processed through Stripe Connect. Here's how it works:

  • You connect your own Stripe account to receive guest payments
  • StaySpark charges a 2.5% platform fee on each guest booking transaction
  • The remaining amount is deposited directly to your connected Stripe account
  • StaySpark never holds guest funds — Stripe handles all payment processing

By using the booking engine, you also agree to Stripe's Terms of Service and our Stripe Connect Terms.

7. Your Content & Intellectual Property

Your content stays yours. When you upload photos, write descriptions, or create guidebook entries, you retain full ownership.

By uploading content to StaySpark, you grant us a limited, non-exclusive license to:

  • Display your content on the website we generate for you
  • Process your content through AI services (OpenAI, Anthropic) for site generation
  • Store your content on our infrastructure (Supabase Storage, Vercel)

This license exists solely to provide the Service and ends when you delete your content or close your account.

Our platform stays ours. The StaySpark platform — including its code, design, AI models, templates, and branding — is our intellectual property. Your subscription gives you a license to use the platform, not ownership of it.

AI-generated content: Websites and content generated by our AI tools are created for your use. You may use them freely for your rental business. However, the underlying templates, algorithms, and generation tools remain our property.

8. Your Obligations

As a StaySpark user, you agree to:

  • Comply with all applicable laws, including local short-term rental regulations
  • Only list properties you have the legal right to rent
  • Provide accurate property information to guests
  • Handle guest relationships, disputes, and stays responsibly
  • Follow our Acceptable Use Policy
  • Not resell, sublicense, or white-label the Service without written permission

9. Prohibited Uses

You may not use StaySpark to:

  • List properties you don't own or have authorization to rent
  • Engage in fraud, deception, or misleading practices
  • Distribute malware, spam, or harmful content
  • Scrape, reverse-engineer, or copy the Platform
  • Violate any applicable law or regulation
  • Harass, discriminate against, or harm others

10. Account Suspension & Termination

We may suspend or terminate your account if you:

  • Violate these Terms or any of our policies
  • Engage in fraudulent or illegal activity
  • Fail to pay subscription fees after reasonable notice
  • Are inactive for an extended period (we'll warn you first)

What happens when your account is terminated:

  • Your generated website(s) will go offline
  • You'll have 30 days to export your data (contact support@stayspark.io)
  • Stripe Connect payouts for completed bookings will still process
  • We'll delete your data per our Privacy Policy

You can close your account anytime from your account settings or by emailing support@stayspark.io.

11. Limitation of Liability

To the maximum extent permitted by law:

  • StaySpark is provided "as is" and "as available"
  • We don't guarantee uninterrupted service, especially during beta
  • We're not liable for indirect, incidental, consequential, or punitive damages
  • Our total liability is limited to the amount you've paid us in the 12 months preceding the claim
  • We're not responsible for disputes between you and your guests
  • We're not responsible for Stripe's handling of payments or payouts

We are not a party to your rental agreements. StaySpark provides tools; you run your business. Guest disputes, property damage, local regulations, and booking issues are your responsibility.

12. Indemnification

You agree to indemnify and hold StaySpark harmless from any claims, losses, or damages arising from:

  • Your use of the Platform
  • Your rental business operations
  • Content you upload or publish through the Platform
  • Your violation of these Terms or any applicable law

13. Dispute Resolution

If you have a dispute with StaySpark:

  1. Contact us first at support@stayspark.io — most issues can be resolved directly
  2. Informal resolution: We'll try to resolve the dispute within 30 days
  3. Binding arbitration: If we can't resolve it informally, disputes will be settled by binding arbitration in Charlotte, North Carolina, under the rules of the American Arbitration Association
  4. No class actions: You agree to resolve disputes individually, not as part of a class action

Governing law: These Terms are governed by the laws of the State of North Carolina, without regard to conflict of law principles.

14. Changes to These Terms

We may update these Terms from time to time. When we do:

  • We'll post the updated Terms on this page with a new "Last Updated" date
  • For significant changes, we'll notify you by email
  • Continued use of StaySpark after changes means you accept the updated Terms
  • If you disagree with changes, you can cancel your subscription

15. Third-Party Services

StaySpark integrates with several third-party services to provide the Platform:

  • Stripe — Payment processing
  • Vercel — Website hosting
  • Supabase — Data storage
  • OpenAI / Anthropic — AI content generation
  • Umami Analytics — Privacy-friendly analytics
  • Microsoft Clarity — UX analytics (session replay, heatmaps)
  • Resend — Email delivery

Each of these services has its own terms and privacy policies. We choose partners carefully, but we're not responsible for their services.
