Marketing & Email Consent

This document explains what emails StaySpark sends, how we obtain your consent, and how you can opt out. We comply with the CAN-SPAM Act, GDPR, and CASL.


1. Types of Emails We Send

Transactional Emails (No Opt-In Required)

These are necessary to operate your account and are not marketing:

  • Account creation and verification
  • Password reset requests
  • Booking confirmations and notifications
  • Payment receipts and billing alerts
  • Account changes and security alerts
  • Service disruption or maintenance notices
  • Policy updates

You cannot opt out of transactional emails while maintaining an active account.

Marketing Emails (Opt-In Required)

These require your explicit consent before we send them:

  • Product updates and new feature announcements
  • Tips for improving your direct booking website
  • Industry news and short-term rental insights
  • Promotional offers or plan upgrade suggestions
  • Case studies and host success stories
  • Surveys and feedback requests

2. How We Get Consent

We use explicit opt-in for marketing emails. This means:

  • During signup, a separate, unchecked checkbox asks: "I'd like to receive product updates, tips, and occasional promotions from StaySpark. You can unsubscribe anytime."
  • We never pre-check the box
  • We never bundle marketing consent with terms of service acceptance
  • We record when and how you gave consent

3. How to Unsubscribe

You can opt out of marketing emails at any time:

  • One-click unsubscribe: Every marketing email includes an unsubscribe link in the footer
  • Account settings: Toggle marketing emails off in your StaySpark dashboard
  • Email us: Send a request to support@stayspark.io

We process unsubscribe requests within 2 business days (CAN-SPAM allows up to 10; we aim for faster).

4. Email Service Provider

We use Resend to deliver all emails (transactional and marketing). Resend processes email addresses and email content on our behalf. See our Privacy Policy for details.

5. Our CAN-SPAM Commitments

Every marketing email we send will:

  • Clearly identify StaySpark as the sender
  • Include a valid physical mailing address
  • Include a clear, conspicuous unsubscribe mechanism
  • Use accurate subject lines (no deception)
  • Be clearly identifiable as marketing/promotional when applicable

6. Guest Communications

Hosts may use StaySpark's guest CRM to communicate with their guests. StaySpark provides the tools, but:

  • Hosts are responsible for their own email compliance
  • Hosts must not use the CRM for unsolicited marketing to guests without consent
  • StaySpark does not send marketing emails to guests — only transactional booking communications
